Phillip Lucas specialises in defending all types of Road Traffic cases and is considered to be pre-eminent in this field. He was called to the Bar in 1995 and has focussed exclusively on motoring law since 2002.

He is known for his ability to identify defences in apparently “hopeless” cases. He has a reputation for tenacity and attention to detail and is well able to stand up to judicial pressure.

He specialises in:

Drink and Drug Driving, Speeding, Dangerous and Careless Driving (including motor manslaughter cases).

In particular:

  • Challenges to the reliability of breathalyser results and speed readings,
  • Challenges to the reliability of laboratory results in drug and alcohol cases,
  • Technical and legal procedural points with regard to alcohol, drug and speeding cases,
  • Challenges to the Type Approval of breathalyser and speed detection devices,
  • Signage and road markings,
  • Driver identification cases (Section 172 R.T.A. 1988).

Phillip has long-standing, good working relationships with forensic toxicologists, breathalyser experts and accident reconstruction experts. He has developed an understanding of the relevant scientific principles which apply to these areas. He is up to date with the current issues with laboratory analyses and is fully conversant with the technical specifications of the different type approved instruments.

Phillip has appeared in a number of reported cases, including:

Director of Public Prosecutions v MJW [2017] EWHC 1070 (Admin)

Balogun v Director of Public prosecutions [2010] EWHC 799 (Admin)

Director of Public Prosecutions v Wood and McGillicuddy [2009] EWHC 32 (Admin)

Phillip undertakes direct access work and works with many of the leading defence solicitors specialising in this field.
