Civil Barrister

The main area of work in Alun’s civil practice is personal injury. He also deals with trusts, landlord and tennant, insolvency and construction law. Trusts of land cases are a particular speciality, involving cases that often have family context.

Notable Cases

  • Thomas Pocklington’s Gift Trustees v Hill [1989] 2 EGLR 97 CA: Landlord and tenant; Rent Act 1977; death of tenant during contractual or statutory tenancy, occupation by one daughter and subsequently by second daughter; complex analysis of status of all three; whether landlord entitled to possession against second daughter.
  • Hamlin v Hamlin [1986] Fam 11 CA: The court has jurisdiction under s 37 of MCA 1973 to restrain the disposal of property situated abroad.

Family Barrister

Alun’s family practice involves all areas of family law. In particular he deals with a high volume of ancillary relief cases, including cases with a high asset base, section 37 applications and cases involving overseas property and offshore trusts.

In addition he deals with both private and public law children’s cases. His private law practice, in addition to residence and contact, includes Hague Convention cases, applications for leave to remove, and domestic violence. He has particular expertise in relation to conflicts between parents as to religious upbringing of children. His public law practice is mainly conducted on behalf of parents.

Notable Cases

  • M v H [2008] EWHC 324 (Fam) FD: Shared residence order; mother in Germany, father in UK; dispute over whether child should attend school in Germany or England. “Least worst” option to direct school in England.
