Joe has considerable experience in representing clients before the First-tier Tribunal, the Upper Tribunal, the High Court and the Court of Appeal.  He is a fee paid Judge of the First-tier Tribunal (Immigration and Asylum Chamber).  He also sits as a Judge in the Employment Tribunal.

Joe is a dynamic and fearless advocate who is always well prepared.  He has extensive experience representing vulnerable clients in asylum and immigration matters, both in appeals and judicial review claims.  Joe’s calm and friendly manner always inspires confidence in those he represents.

Joe has practiced crime to a high level although he now practises almost exclusively in immigration law.  He has appeared on Sky News as commentator on immigration law.  He has often spoken at seminars and conferences, including at the ILPA conference on EU Law and the Law Friends Conference on Tribunal Advocacy.  In 2018 he was twice invited to lecture on advocacy in Lahore.  He has also lectured at Essex University.

Notable Cases

AS v SSHD (UT – Judicial Review)

A challenge to the refusal of ILR on the basis of a refusal under paragraph 322(5) of the Immigration Rules.

ADS v SSHD (Admin Court)

Heard before Mr Justice Green in the Administrative Court, the issue was whether or not an applicant should be refused naturalisation on the basis that in his asylum claim of 20 years ago he stated that he was a member of the MPLA in Angola.

DS v SSHD (UT – Appeal)

The issue was whether or not an unmarried partner was entitled to a retained right of residence on the basis of domestic violence given the fact that a married partner would be entitled to a retained right of residence.

(VV (grounds of appeal) Lithuania [2016] UKUT 00053 (IAC)

This case was a Home office appeal heard by Mr Justice Holgate and was a timely reminder to all those seeking to appeal an FTT decision on the grounds of inadequacy of reasoning.

MI v SSHD (UT – Judicial Review)

This case involves the curtailment of the applicant’s leave to remain on the basis that they allegedly submitted a fraudulently obtained TOEIC certificate.
