Toby Roseman is a highly regarded criminal barrister with extensive experience in both defence and prosecution across all levels of the criminal courts, including the Crown Court and the Court of Appeal. He is a Grade 3 Prosecutor, regularly instructed by the CPS in complex and serious criminal cases. Aggravated burglary case involving two defendants wielding 9-inch Rambo knives who held a family captive in a bedroom in order to steal money.

5-day trial for the possession of Category A indecent images of children.
- 2024 R v K & Ors | Ipswich Crown Court
Acted as junior prosecution counsel, led by Jerry Hayes, in the prosecution of five defendants for concealing and transferring criminal property outside of the UK in a conspiracy valued at £4.5 million over two years.

Successfully argued against an abuse of process application in a fraud case involving an employee defrauding their employer.

Defendant had strangled his partner and intentionally wounded three neighbours who intervened, attacking them with a kitchen knife.

Money laundering case involving a courier transferring over £150,000 in cash in a briefcase.
- 2023 R v M | Court of Appeal – Criminal Division
Successfully argued an appeal against sentence for multiple counts of making indecent photographs of children. Succeeded in reducing a custodial sentence down to a community order. Reported case.
- 2023 R v Z | Guildford Crown Court
Successfully argued there was no case to answer when defending a trial involving being concerned in the supply of Class A & B drugs. The defendant’s DNA was found on the lid of a container containing 1kg of ketamine.
- 2023 R v F & Ors | Luton Crown Court
Led as junior counsel by Meyrick Williams in a trial of aggravated burglary and conspiracy to rob, involving nine defendants armed with machetes, robbing a cannabis factory.
- 2023 R v B & M-B | Basildon Crown Court
Prosecuted two men attempting to rob a jewellery shop armed with weapons and wearing lifelike latex masks to disguise themselves as elderly men. They were sentenced to 18 years and 13 years respectively.
- 2022 R v O | St Albans Crown Court
Successfully applied to exclude hearsay evidence of a key witness (now deceased) when defending a fraud case, leading to the Crown offering no evidence.

Toby is regularly instructed to appear on behalf of the defence, prosecution and probation in the Crown, magistrates’ and Youth Courts. He is a Level 3 on the CPS Advocate Panel and also has experience in private prosecutions.
Toby has gained substantial experience in written advisory work and research and accepts instructions to advise appeals against conviction and sentence.
Civil Barrister
Toby accepts instructions in actions against the police having gained substantial experience in this area during his pupillage and being well versed in dealing with police witnesses in the criminal courts. He accepts instructions to advise and represent injured parties in their proceedings.
