Court of Appeal grants permission to appeal in a case of wider public importance: Hasanaj v SSHD

News

Sanaz Saifolahi and Anthony Metzer KC instructed by Hayk Sayadyan of Gulbenkian Andonian.

The Court of Appeal has granted the Applicant permission to appeal in a case of wider public significance involving an extended family member who entered the U.K. after being granted entry under The Regulations at port prior to 31.12.2020. The SSHD, as upheld by the Upper Tribunal, found that as the Applicant had made his EUSS application after the relevant date, he did not fall under the WA and an entry stamp under The Regulations prior to the relevant date does not fall within the definition of relevant document or otherwise for the purposes of the EUSS.

Sanaz Saifolahi and Anthony Metzer KC drafted the grounds to the Court of Appeal.
