Meyrick Williams successful in Modern Slavery Defence – Prosectuion Offered No evidence, Ipswich May 2022

In May the CPS offered no evidence in relation to a young, alleged Class A drug dealer. There was no dispute the defendant had so acted but it was submitted on his behalf section 45 Modern Slavery Act 2015 applied and the defendant was a victim of modern slavery. 

In this case Meyrick advised on the nature of the defence to be raised and the procedure. The defendant was willing to be further interviewed by the police with the assistance of his solicitors Maurice Andrews [Tabrace Husssain]. The defendant also had the advantage of images showing injuries received as part of his duress defence running side by side long with other evidence obtained by the solicitor. All of this put together showed a “verifiable defence”. Both the reasonable grounds and conclusive grounds decisions were in his favour. Should the defendant have been unsuccessful under either defence he faced a significant custodial sentence.
