Dr Anton van Dellen in the Court of Appeal in a declaration of trust case

Dr Anton van Dellen represented an Appellant on 18th October 2017 in the Court of Appeal in a case which considered the requirements for recording a declaration of trust under section 53 of the Law of Property Act 1925.  The Court of Appeal held that the terms of the declaration should be recorded in writing to reflect the intention of the person creating the express trust.  Melissa Rutherford of Duncan Lewis instructed Dr Anton van Dellen.
