Anthony Metzer QC, with solicitor Gary Lesin-Davis of W Legal, obtained a successful result for their client, following the threat of using the criminal law of coercive and controlling behaviour in an intimate relationship.
Had the case needed litigating, this would have been a second landmark case. However, Anthony’s innovative suggestion of employing Section 76 of the Serious Crime Act 2015 was significant as the recalcitrant husband speedily provided the Jewish religious divorce certificate (‘get’) after many previous years of withholding it, which avoided the necessity of such a private prosecution.
