Court of Appeal lists hearing for Jen and Jamie Ltd v SSHD Appeal

The Court of Appeal has listed the hearing of the Civil Penalty Notice (“CPN”) appeal in Jen and Jamie Ltd v Secretary of State for the Home Department for 13th and 14th October 2026.

Emma Harris and Brenda Efurhievwe secured permission to appeal the decision dismissing the CPN appeal in Jen and Jamie Ltd v Secretary of State for the Home Department [2025] EWCC 41, [2025] 7 WLUK 288. Permission was granted regarding the question of the exercise of judicial discretion and the consideration of mitigating factors outside of the Secretary of State’s Code of Practice, when assessing the level of penalty in a CPN appeal.  The County Court decision under appeal can be accessed here.
