Dr Anton van Dellen recently successfully represented a client on appeal, in a dispute involving appointment of an LPA receiver by a mortgage lender, following which possession was ordered. The appeal concerned whether the LPA receivers were validly appointed given the release of equity from other properties that had been sold and whether consolidation of separate mortgages (cross-collateralisation) was allowed under the terms of the mortgage conditions. The Judge agreed to remit the matter back to the first instance court for the issues to be decided again.
