Dr Charlotte Proudman succeeds in appeal of rape, domestic abuse and coercive and controlling behaviour case

Dr Proudman is an experienced family law practitioner at Goldsmith Chambers. She specialises in appellate work in the field of violence against women and girls.

Dr Proudman was successful in her application for permission to appeal a fact-finding hearing decision on behalf of the mother. Despite, the appeal application being made out of time, Dr Proudman secured permission to appeal. 

The mother’s substantive appeal application was allowed by consent. A Judge of the Family Court failed to give adequate reasons for dismissing the mother’s allegations of rape, domestic abuse and coercive and controlling behaviour and the Judge failed to give adequate reasons for making the findings that the Judge did, which breached the mother’s Article 6 and 8 Convention rights. The matter shall be remitted for a re-trial before another judge.

The appeal was heard in open court.
