Dr Charlotte Proudman wins permission to appeal for a mother in domestic abuse case

Dr Proudman successfully persuaded the appellate court in family proceedings to grant permission to appeal a judgment of a lower court. Dr Proudman was instructed by a mother in complex private law proceedings involving allegations of child abuse, domestic abuse & coercive and controlling behaviour. Dr Proudman argued that it was wrong for the trial Judge not to address the mother’s allegations of domestic abuse and coercive and controlling behaviour as they are relevant to the child’s welfare and an assessment of risk of harm to the child by the alleged perpetrator. Dr Proudman relied on PD12J & H-N and Others [2021], a Court of Appeal decision in which Dr Proudman acted for two of the appellant mothers. The appellate court concluded that there was a real prospect of success. The substantive appeal will be heard later in the year.
