The vulnerable appellant was trafficked to the UK and exploited. She feared returning to her home country where the risk of being re-trafficked remained high and she was experiencing complex mental health needs that required ongoing support. Edward argued that she and her young children would be at risk of further exploitation if returned, where the availability of support is inadequate and where she remained at risk from the original traffickers. The appellant had also been disowned by her family following the revelation of her exploitation.
Edward successfully argued that the risk to the appellant remained high regardless of whether she internally relocated or relied upon inadequate state protection.
The appeal was allowed on protection and human rights grounds.
Edward specialises in complex immigration and asylum appeals. He accepts instructions in all aspects of Immigration and Public Law, as well as Crime.
