George Symes successfully defends High Court Chancery claim

Baylis & Anor v Haider & Ors [2024] EWHC 187 (Ch)

George Symes successfully defended a claim in the High Court Chancery Division after a five-day trial, raising points of non est factum, mistake, unjust enrichment, rectification of the land registry, and regulated activities under the Financial Services and Markets Act 2000.

Despite having signed a TR1, the Claimants sought to argue that the sale of their property was never intended to transfer ownership and it should be transferred back to them. Deputy Master Rhys found that the parties had in fact agreed a sale, and the First Defendant was entitled to keep the property.

George was instructed by Santers Solicitors.
