Nationality & Immigration Bill Cont.

On 6th July 2021, the Government published its Nationality and Immigration Bill. This is now progressing through the House of Commons having undergone the 2nd reading on 19th July 2021. It is understood that the Bill will go to Committee Stage later this month.

Several members of the immigration and public law team contributed to Free Movement‘s analysis and comment of the Bill. Starting with Chapter 1 devoted to Nationality law, Emma Harris wrote her ‘Briefing: the Nationality and Borders Bill, Part 1 (citizenship reforms)’.

Chapter 2 which contains the government’s proposals in relation to asylum was succinctly covered by Samina Iqbal, Alexis Slatter, Sarah Pinder and Krystelle Wass, kindly coordinated by Emma Harris: ‘Briefing: the Nationality and Borders Bill, Part 2 (asylum)’. Across these contributions, the following clauses and themes were explored: differential treatment of asylum seekers, place of claim, treating asylum claims as inadmissible, evidence and accelerated detained appeals and certification.

Sarah Pinder was also able to add her analysis and comment to the ‘placeholder’ clause concerning age assessments and the good faith clause, included in Free Movement’s Briefing on Chapter 5 containing miscellaneous provisions: ‘Briefing: the Nationality and Borders Bill, Part 5’.
