In the latest edition of ILPA’s Blog, available here, Emma Harris writes about the recent crackdown against illegal working and the serious consequences for employers who receive civil penalty notices.
Employers face a first-time penalty of £45,000 per illegal employee as well as the reputational damage of having their business named and shamed on the government website. Directors of companies that employ illegal workers face further enforcement action by the Insolvency Service who have lately banned directors from directly or indirectly becoming involved in the promotion, formation or management of a limited company for six to ten years as a further result of employing illegal workers.
With all of this at stake, Emma explains the process for challenging civil penalty notices and gives tips from her own experience of these cases on appeal.
