Alun Jenkins acted for the parents in the High Court on Friday 5th September and Monday 8th September in the case of Portsmouth City Council v King & King, when we obtained the Court’s leave to take the child Ashya King to Prague for proton beam therapy at the Proton Therapy Center.

The Judge’s final order was a ringing endorsement of the right of parents to make decisions for and on behalf of their children in relation to treatment they are to receive, provided that the parents’ decisions do not place the child at risk of significant harm. In this case we established that the parents’ wish to take Ashya to Prague, and the treatment plan that was proposed in relation to that, were reasonable, and that the Court, indeed the State, should not therefore interfere.
