Sarah Memmi, instructed by Helen Ricks of GT Stewart Solicitors, represented H at trial charged with one count of robbery. Sarah made a successful application to adduce hearsay evidence which undermined the complainant’s account and credibility. She extensively cross-examined the complainant, drawing out the numerous inconsistencies in the various accounts she had given in court, to police officers and across three statements. Sarah also explored the failures from the Crown to secure vital evidence which could have further undermined the complainant’s account and supported the defendant’s, including CCTV, Body Worn Video and medical records for the complainant.
The jury returned a unanimous verdict of Not Guilty.
